Cody Keith Ledbetter, 29, of Waco, was charged by Mexia PD with unlawful carrying of a weapon and marijuana possession, according to jail records.

Jail records show Ledbetter was booked into the Limestone County Detention Center before 6 a.m. Saturday, and by 10:15 a.m. Sunday he had been released.

In March 2018, a Waco judge dismissed the case against Ledbetter who was charged in the aftermath of the deadly biker shootout on May 17, 2015 that left nine dead, including his father Daniel Boyett, and about two-dozen injured, including himself.

“He (Ledbetter) is a totally free man and is able now to live his life as he wishes after three years of prosecutorial misconduct,” Ledbetter’s Houston-based attorney, Paul Looney, said at the time.

Had his case gone to trial, Ledbetter would have only been the second Twin Peaks defendant to see a jury of the more than 150 bikers indicted.

Of those cases, only 24 remain with the McLennan County District Attorney’s Office.

Barry Johnson, the new DA who inherited Twin Peaks, said Monday they’re working hard on deciding what to do with those cases.

“It’s more complicated than I thought, I want to make the right decision for the county and the citizens,” Johnson told KWTX. “It’s going to be a tough decision any way you cut it, but we’ve got to do the right thing.”

Johnson said he wanted to have decisions made by April 1, but now believes it’s going to take longer than he’d hoped.
